The European Commission has approved a new set of controller-to-processor model clauses for use in data transfers outside the EEA. The new clauses address the sub-processor/onward transfer issue, which can be especially challenging for large-scale international outsourcing. But compliance means more than just implementing new clauses. Many European DPAs also require data controllers to obtain "pre-approval" prior to transfer, a process that can take from 30 days to as many as four months depending on the jurisdiction.
