The New Zealand Herald has published an editorial following a recent Human Rights Review Tribunal decision requiring Alpine Energy to provide an unsuccessful applicant with the CVs and references of others applying for the job. “The tribunal recognised applicants would probably have expected their personal information to be kept confidential,” the editors write, but its main focus was “public interest in preventing discriminatory conduct being hidden behind a cloak of confidentiality.” The editors caution, “While the sanctity of anti-discrimination law and the principle of full discovery are vital, surely the discrimination against and invasion of others' privacy requires a clear, fair legislative fix.”
