DPA Imposes Direct Marketing Limitation

Personal data registered in a professional telephone directory cannot be used to propose commercial products or relevant offers without the express consent of the interested professional or other specific conditions. By means of an ad hoc decision, Italy's data protection authority, the Garante, has forbidden a telephone company to use the personal data of a lawyer to call him to promote its telephone products since the direct marketing operation was neither covered by the express consent of the lawyer nor focused on products directly connected to the legal profession.
