The Information Commissioner’s Office (ICO) has ordered a Glasgow-based marketing company to cease its nuisance call practices to members of the public.

DC Marketing Limited made calls to try and persuade people to purchase solar panels partly financed by the Green Deal Home Improvement Fund. An ICO investigation also found that the company frequently gave a false name in order to avoid detection.

Under UK legislation, it is an offence for a company to make marketing calls to an individual who has opted out of receiving such calls by registering their telephone number with the national Telephone Preference Service (TPS) or by informing the company directly. It is also against the law for a company to give out false information in order to avoid being detected.

The ICO became aware that DC Marketing Limited was still contacting individuals who had previously asked not to be contacted after 280 reports were made to the TPS and the ICO by members of the public.

DC Marketing Limited has been served with an enforcement notice ordering it to stop making nuisance calls. A breach of this notice would be treated as a criminal offence.

The enforcement action follows a request from the ICO to members of the public to report automated nuisance calls coming from specific telephone numbers selling boilers, insulation and solar panels. Text messages promoting green energy initiatives and so-called “scrappage schemes”  were responsible for 42 percent of concerns raised with the ICO between January and March.
